Bankruptcy may be right for you, if:
- You have suffered job loss and cannot get ahead of your debt
- You have suffered a severe or debilitating injury and cannot pay medical expenses
- You have recently gone through a divorce and find your debt is unmanageable
- You want to stop the foreclosure of your home
Chapter 7 bankruptcy law:
Chapter 7 discharges all unsecured debts and means that no payments are required. It is also known as "liquidation bankruptcy," meaning that your debts are liquidated along with your assets to pay off those debts. You will be relieved of all unsecured debts including medical expenses, credit cards and other loans. A Chapter 7 is most useful to clients who do not have significant assets they want to protect from bankruptcy.
Chapter 13 bankruptcy law
Under Chapter 13 bankruptcy law, you will be required to make some kind of repayment of debt based on your income. It may be in you best interest to file Chapter 13 if you have issues of late payments on a vehicle, home, or other assets on which installment payments required. You may also seek a Chapter 13 to account for unpaid child support and taxes. Child support and taxes receive priority over other claims, and the penalties might be eliminated.
The objective in a bankruptcy is to obtain a discharge of all the clients eligible debts not paid through bankruptcy. In Chapter 13, all debts that cannot be paid through the payment plan will be discharged as well, so it might not be necessary to pay 100% of unsecured debt in a Chapter 13.
